Terms of Service

Welcome to Lead Machine, a service operated by Halo Peak Technologies ("we", "us"). These Terms govern your use of our websites, lead pages, and related services (the "Service").

By using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. What the Service Is

Lead Machine is a managed lead-generation platform. We help small businesses get leads by building custom landing pages and running Google Ads and Meta Ads campaigns on their behalf. "Customers" are businesses that subscribe; "Visitors" are people who arrive at customer landing pages through ads or organic search.

2. Customer Accounts

• You must be at least 18 and legally authorized to represent your business to create a customer account.
• You're responsible for keeping your login credentials secure and for all activity under your account.
• You must provide accurate business information.
• Violations of these Terms or our acceptable-use policy may result in suspension or termination.

3. Fees and Billing

• Subscription fees are billed monthly via Stripe. Current pricing is shown on leadmachine.live.
• Ad spend (amounts paid to Google and Meta) is billed separately by those platforms directly to you and is not included in our subscription fees.
• You can cancel anytime. No refunds for the current billing period.
• We may change pricing with 30 days notice.

4. Acceptable Use

You may not use the Service to:

• Advertise illegal products or services
• Make false or misleading claims
• Violate Google Ads, Meta Ads, or any other advertising platform's policies
• Infringe third-party intellectual property
• Harass, defraud, or harm anyone
• Transmit malware or spam
• Scrape, copy, or reverse-engineer the Service

5. Regulated Industries

If you advertise in a regulated industry (healthcare/Medicare, financial services, legal services, etc.), you are solely responsible for compliance with applicable laws and platform policies (including HIPAA, TILA, FTC guidelines, state insurance regulations, and any licensing requirements). We may require additional disclosures or disclaimers on your landing pages.

6. Lead Data and Privacy

• Leads captured through your landing pages belong to you and are delivered to your email or dashboard.
• We also retain copies of lead data to operate the Service (provide the dashboard, compute analytics, fire conversion events).
• Our handling of personal information is described in our Privacy Policy.
• You must handle the contact information of your leads in a way that complies with all applicable privacy laws (CAN-SPAM, TCPA, GDPR, CCPA, etc.).

7. Intellectual Property

We retain ownership of the Lead Machine platform, code, and templates. You retain ownership of content you provide (your logo, copy, images). By submitting content, you grant us a worldwide, non-exclusive license to use it for operating and promoting the Service.

8. Third-Party Services

The Service integrates with Google Ads, Meta, Stripe, Resend, and other third-party services. Your use of those services is governed by their terms. We are not responsible for outages or errors caused by third-party providers.

9. Disclaimers

The Service is provided "as is" without warranties of any kind. We do not guarantee any specific number of leads, sales, or conversions. Advertising results depend on many factors outside our control (market conditions, your offer, your product, your follow-up).

10. Limitation of Liability

To the maximum extent permitted by law, Halo Peak Technologies' total liability to you for any claim arising out of the Service is limited to the total fees you paid us in the 12 months preceding the claim. In no event are we liable for indirect, consequential, or punitive damages.

11. Indemnification

You agree to indemnify and hold Halo Peak Technologies harmless from any claim, damage, or expense (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of the Service.

12. Termination

You can cancel anytime from your dashboard or by emailing us. We may terminate or suspend the Service for cause (violation of these Terms) or without cause with 30 days notice. On termination, we retain your data per our Privacy Policy retention schedule.

13. Governing Law

These Terms are governed by the laws of the State of Arizona, United States. Disputes will be resolved in the state or federal courts located in Maricopa County, Arizona.

14. Changes

We may update these Terms from time to time. When we do, we'll update the "Last updated" date and notify active customers by email. Continued use after changes means you accept the updated Terms.
